Implementation of federal legislation in the field of harvesting and collecting of deadwood for their own needs was examined at the meeting of the Committee on Agrarian-Food Policy and Environmental Management of the Federation Council chaired by Deputy Chairman of the Federation Council Yuri Vorobyov. The meeting participants noted that the law enforcement practice identified a number of problems that require legislative solutions, including at the level of the constituent entities of the Russian Federation.
“The topic of deadwood harvesting, affecting the interests of the rural population, is of great social importance. In this situation, citizens who unwittingly became violators of forest legislation are suffering, since the established notion “deadwood” is very vague and requires specialized knowledge in the field of forest protection”, said Mikhail Klinov, Acting Head of the Federal Forestry Agency.
According to the results of the discussion, the Ministry of Natural Resources of Russia recommended to develop a unified definition of deadwood based on existing documents by November 1 of the current year. In addition, recommendations were made to the state authorities of the constituent entities of the Russian Federation on establishment of a single procedure for harvesting and collecting deadwood by citizens for their own needs. Before fixing a single definition of deadwood, the regions are recommended to adhere to the definition contained in the Rules for Procurement and Collection of Non-Wood Resources, approved by the order of the Ministry of Natural Resources of Russia, and at the same time strengthen the explanatory work with the population.
For reference. Federal Law No. 77-FZ of April 18, 201 “On Amendment of Article 32 of the Forestry Code of the Russian Federation” referred deadwood to non-timber forest resources, which citizens collect and harvest for their own use freely and free of charge in accordance with Part 1 of Article 11 of Forestry Code of the Russian Federation. The definition of “deadwood” is contained in the order of the Ministry of Natural Resources of Russia on July 16, 2018 No. 325 “On Approval of the Rules for Procurement and Collection of Non-Timber Resources”, but these rules relates only to legal entities and commercial structures.
