The Ministry of Natural Resources of Russia has developed a draft order on the norms applicable to the forest declaration
The Ministry of Natural Resources and Environment of the Russian Federation has prepared a draft order “On approval of the forest declaration form, the procedure for filling and submitting it, requirements for the format of the forest declaration in electronic form”.
In accordance with clause 8 of the Federal Law of 04.02.2021 No. 3-FZ “On Amendments to the Forest Code of the Russian Federation and Certain Legislative Acts of the Russian Federation in terms of improving the legal regulation of forest relations”, forest declarations are submitted in the form of an electronic document.
The draft order has improved the procedure for the applicant to receive a notification of acceptance or refusal to accept a forest declaration, while a notice of acceptance or refusal to accept a forest declaration is sent to the applicant in electronic form.
In addition, it clarifies that the use of forests by forest users is possible only after receiving a notification of the acceptance of a forest declaration; cases of possible use of forests in the absence of a forest declaration adopted by an authorized authority due to a forest user not receiving a notification of refusal to accept a forest declaration, for reasons independent of him, are excluded.
In order to ensure the possibility of submitting a forest declaration in electronic form, a new form of a forest declaration is envisaged.
At the same time, the forest declaration form was supplemented with an appendix providing information on the coordinates of the cutting areas.
The draft order is posted on the Unified Information Disclosure Portal on the preparation by federal executive authorities of draft regulatory legal acts and the results of their public discussion on the Internet (regulation.gov.ru) for public discussion, as well as independent anti-corruption expertise.
