Rosleskhoz explains the provisions of Article 50.4-1 of the Forest Code of the Russian Federation

In connection with numerous appeals, the Federal Forestry Agency clarifies the provisions of Article 50.4-1 "Places (points) of timber storage (timber warehouses)" of the Forest Code of the Russian Federation.

Recall that, following Part 1 of Article 4 of the Federal Law of 04.02.2021 No. 3-FZ, persons who own, by right of ownership or on another legal basis, places (points) for storing wood, objects of wood processing infrastructure, are obliged to submit to the operator of the unified state automated information system of timber accounting and transactions with it (LesEGAIS) information provided for in clauses 11 and 12 of part 9 of Article 50.6 of the Forest Code in the form of an electronic document signed with an enhanced qualified electronic signature, by posting them in LesEGAIS or an authorized public authority or local government body using information and telecommunication public networks, including the Internet, including a single portal of state and municipal services.

By the draft decree of the Government of the Russian Federation "On Approval of Requirements for the Location and Characteristics of Wood Storage Sites (Points)", timber storage refers to all storage sites for wood and its processed products, information about which is entered in the state forest register, in LesEGAIS and having identification room.

These requirements do not apply to:

- places of storage of wood obtained during the implementation of its harvesting by persons entitled to such harvesting on the grounds provided for by the Forest Code, within the boundaries of the cutting area;

- places of wood processing in the production of wood processing products specified in part 1 of Article 501 of the Forest Code;

- storage areas for timber harvested by citizens for their own needs, purchased by citizens and organizations;

- in the retail market or retail trade organization owned by state or municipal institutions (except for institutions specified in Article 19 of the Forest Code), and used exclusively for the needs of citizens, relevant institutions, and organizations.
