Clarifications of Rosleskhoz on the formation of ESD and QR codes
Due to the large number of questions received by the Federal Forestry Agency about the procedure for filling out an electronic accompanying document for the transportation of timber (ESD) and verifying the information it contains, the agency's specialists explain the following.
From January 1, 2022, following Article 50.4 of the Forest Code of the Russian Federation (as amended by Federal Law No. 3-FZ), the transportation of wood and its products is allowed after the formation of the ESD. The form and composition of the information included in the ESD for the transportation of wood and its processed products are approved by Decree of the Government of the Russian Federation No. 2214 dated December 6, 2021.
To practically implement the norm on the formation of ESD, the functioning of specialized software was organized: the m.lesegais.ru web portal, as well as the “LesEgais.Mobile” mobile application, for iOS and Android operating systems (specialized software). These software solutions allow you to generate electronic accompanying documents in the prescribed manner.
Formation of electronic accompanying documents using other software is not allowed and is illegal.
When forming the ESD, part of the information is filled in by specialized software in automatic mode. For example, data on the owner of wood is requested from a unified system of identification and authentication, and geographic coordinates, the date and time of the creation of the ESD are determined using geopositioning tools built into the mobile device and determining the date and time, which function, among other things, with certain accuracy and error, independent of forest users. The user does not have the technical ability to change these data or affect their accuracy.
When filling in the ESD fields, specialized software performs format-logical control of several fields, in particular, it does not allow the formation of an ESD with empty fields in terms of the place of departure, destination, volume, and species composition of the transported wood, without specifying the TIN and other information about the carrier, type and number vehicle. In case of incomplete indication, including the named data, or the introduction of an incorrect data format (for example, indicating the TIN in the form of letters or the wrong number of digits), specialized software does not allow signing the ESD.
If the forest user has entered all the necessary information into the ESD and it has passed the format-logical control, specialized software allows you to sign the ESD and generates a special QR code confirming the fact of signing the ESD.
Thus, the presence of a special QR code by a person carrying out the transportation of wood, which is correctly read by specialized software, confirms, firstly, that this QR code was generated in the corresponding software, and, secondly, that the person filled out all necessary fields with data that have passed format-logical control.
Specialists note that the QR code itself is intended solely for the operational validation of information about the presence of a signed ESD in the Unified State Automated Information System for accounting for wood and transactions with it and is not an ESD.
Due to the technological features of the QR code format, and restrictions on the amount of recorded information, the QR code contains a link to the ESD in the web version of the specialized software, the necessary technical information, as well as data that can be checked directly during the inspection of the vehicle in the absence of access to the Internet, namely the vehicle number, the volume and species composition of wood, points of departure and destination. All other information provided by Decree of the Government of the Russian Federation No. 2214 dated December 6, 2021, is not recorded in the QR code and, accordingly, is not displayed when reading the QR code.
Based on the foregoing, it follows that the absence of the full composition of information from the ESD in the QR code is not an offense and cannot in itself serve as a basis for holding a person liable for the absence of an ESD. Information from the ESD is stored in full in the modernized LesEGAIS segment and is available for viewing by employees of regulatory authorities on the website m.lesegais.ru.
