The Ministry began work on the adoption of forest declarations and reports established by the Forest Code of the Russian Federation

The Ministry of Forestry of the Republic of Tatarstan has begun work on the acceptance of forest declarations and reports established by the Forest Code of the Russian Federation.

According to Part 8, Article 4 of the Federal Law of February 4, 2021, No. 3-FZ “On Amendments to the Forest Code of the Russian Federation and Certain Legislative Acts of the Russian Federation in Part of Improving the Legal Regulation of Forest Relations” (as amended on July 2, 2021, 303-FZ) from July 1, 2021, forest declarations, reports on the use of forests, on the protection of forests from fires, on the protection of forests, on reforestation and afforestation are submitted exclusively in the form of an electronic document using a single portal of state and municipal services and (or ) regional portals of state and municipal services.

Following Article 26 of the Forest Code of the Russian Federation, persons to whom forest plots have been leased or for permanent (unlimited) use must submit a forest declaration to the Ministry of Forestry of the Republic of Tatarstan. A forest declaration is a statement about the use of forests following a forest development project.

The forest declaration is submitted in the form of an electronic document, which is formed in the form of XML files. The forest declaration form, developed in the form of an XML schema, as well as the developer's guide for working with the electronic document form, are posted on the official website of Rosleskhoz. The forest declaration is submitted at least 6 working days before the start of the expected period of forest use. The validity period of the forest declaration is no more than 12 months from the date of commencement of the expected period of use of the forests.

The form of the forest declaration, as well as the procedure for filling out and submitting it, and the requirements for the format of the forest declaration in electronic form were approved by the Order of the Ministry of Natural Resources and Ecology of the Russian Federation dated April 29, 2021 N 303 “On approval of the forest declaration form, the procedure for filling out and submitting it, requirements to the format of the forest declaration in electronic form”.

Order of the Ministry of Natural Resources and Ecology of the Russian Federation of July 30, 2020 N 539 “On approval of the forest declaration form, the procedure for its completion and submission, requirements for the format of the forest declaration in electronic form” was declared invalid.

Also, following articles 49, 60, 60.11, and 66 of the Forest Code of the Russian Federation, citizens, including individual entrepreneurs, and legal entities that use forests, submit the following types of reports to the Ministry of Forestry of the Republic of Tatarstan:

- report on the use of forests,

- report on the protection of forests from fires,

- forest protection report,

- report on reforestation and afforestation.

Reports are submitted in the form of an electronic document, which is generated as XML files. It is allowed to generate reports in the form of an electronic document in XLS format.

A report on the use of forests is submitted by citizens, including individual entrepreneurs, and legal entities engaged in the use of forests, monthly, no later than the tenth day of the month following the reporting month (when using forests for timber harvesting, as well as when using forests for other purposes, when which forest plantations were cut down). In cases where no felling of forest plantations was carried out during the use of forests, the report is submitted annually, no later than January 10 of the year following the reporting one.

The form of the report on the use of forests and the procedure for its submission, as well as the requirements for the format of the report on the use of forests in electronic form, are established by order of the Ministry of Natural Resources and Ecology of the Russian Federation dated August 21, 2017 No. 451.

A report on the protection of forests from fires is submitted by citizens, including individual entrepreneurs, legal entities that use forests following the Forest Code of the Russian Federation, and also carry out measures to protect forests, quarterly, no later than the tenth day of the month following the reporting period. In cases where the forest development project, and forest management regulations do not provide for measures to protect forests in the reporting quarter, the report is submitted annually, no later than January 10 of the year following the reporting one.

The report on the protection of forests is submitted by citizens, including individual entrepreneurs, and legal entities that use forests following the Forest Code of the Russian Federation, as well as carry out forest protection measures, quarterly, no later than the tenth day of the month following the reporting period. In cases where the forest development project, and forest management regulations do not provide for measures to protect forests in the reporting quarter, the report is submitted annually, no later than January 10 of the year following the reporting one.

The form of the report on the protection of forests from fires and the report on the protection of forests, as well as the procedures for their submission, are established by order of the Ministry of Natural Resources and Ecology of the Russian Federation dated March 09, 2017 No. 78.

The report on reforestation and afforestation is submitted by citizens, including individual entrepreneurs, and legal entities engaged in reforestation and afforestation, quarterly no later than the tenth day of the month following the reporting period. In cases where the forest development project and forestry regulations during the year do not provide for measures for reforestation and afforestation, the report is submitted annually, no later than January 10 of the year following the reporting one.

The form of the report on reforestation and afforestation and the procedure for its submission are established by order of the Ministry of Natural Resources and Ecology of the Russian Federation dated August 21, 2017 No. 452.
